WHAT THE RECORD SHOWS

Summary, 8 October 2026

The core claim

Almost every case argues the same thing. Buying Gold Coins that come with Sweeps Coins is consideration, the games are chance, and SC redeem for cash, so the site is illegal gambling. Plaintiffs then use old gambling-loss recovery statutes (see the Statutes tab; Kentucky allows treble recovery by third parties) to claw back purchases. Add-on claims: consumer protection, civil RICO, unjust enrichment, underage play, BNPL financing, and aiding and abetting by streamers, vendors and payment firms.

Money paid so far

Larsen v. High 5 (WA): judgment $24.93M, then a $12M to $30M settlement (final approval hearing 8 Feb 2027). VGW Kentucky class (Armstead): $11.75M. NY AG v. VGW: $8M. Connecticut v. High 5: about $1.5M, including $643k restitution to 794 players, after 1,065 criminal counts were announced. Kentucky settlements: Whiting v. Pulsz $1.32M, a second Pulsz deal reported at $3.6M, Woopla $835k, PrizePicks up to $1.75M. Pulsz six-state class: 27% of spend back in coins or 23% in cash. Louisiana Revenue is suing VGW (about $30.5M) and WOW Vegas (about $13.6M) for unpaid sales tax.

How operators win

Arbitration clauses. Stake.us got arbitration compelled in Boyle, M.M./Deleon, Hall, Dixon, Gardner, Ridley and Thomas (MS, 28 Sep 2026). VGW, Blazesoft (Ambrosia), Sportzino (Boatner), Modo and McLuck won similar motions. Standing: suits by non-players and litigation-funded plaintiffs claiming other people's losses have failed (Burt v. Playtika, Cayce v. VGW, KGR v. Underdog). Knapp v. VGW was dismissed and the appeal was dismissed on 28 Sep 2026. Operators also go on offense: Zula and Sportzino sued the mass-arbitration law firms (dismissed under NY anti-SLAPP, Mar 2026) and Stake.us is enforcing an AAA award against a player.

How plaintiffs get around that

No proof the player agreed: Wolters v. Stake.us (arbitration denied, now at the 8th Circuit) and Urdan v. Stake.us (denied pending discovery on contract formation). Terms the operator can change retroactively: Miranda v. Modo (D. Mass., 14 Sep 2026, on appeal). Unconscionable clauses: Portugal v. High 5 (SF Superior Court). Spouses who never accepted the ToS: Brown v. VGW. Mass arbitration that runs up fees (Zula/Sportzino: about 966 demands, about $1.5M in AAA fees). Government suits, which no arbitration clause covers.

Appeals to watch

Ambrosia v. Blazesoft (7th Cir., argued 1 Oct 2026). Boatner v. SSPS (2d Cir., interlocutory appeal granted). Wolters v. Stake.us (8th Cir., player brief due 13 Oct 2026). Miranda v. Modo (1st Cir.). The Apple/Google/Meta casino-app MDL (9th Cir.). These rulings will decide whether sweeps arbitration clauses hold up.

Who gets sued

Not only operators. Executives (Florida v. Stake names Ed Craven and Bijan Tehrani). Payment and KYC vendors (Worldpay, Trustly, Yodlee, Jumio, Veriff, Breeze Labs, Praxis). Game studios (Evolution, Pragmatic, Hacksaw and others in the LA City Attorney suit; Evolution got out on jurisdiction 21 Aug 2026). Streamers and celebrities (Drake, Adin Ross, DJ Akademiks, Ryan Seacrest). App stores, BNPL lenders (Affirm) and ad platforms. Oklahoma's new law names affiliates, suppliers and geolocation providers.

Government action

Suits: Kentucky AG, Florida AG (vs VGW and vs Stake), NY AG, City of Baltimore, LA City Attorney (asking at least $1.44B restitution plus $987M penalties from Stake and others), Washington AG vs Playtika/Aristocrat. Cease-and-desist waves: NY AG (26 brands, Jun 2025), Tennessee AG (about 40 letters, Dec 2025), Illinois, Michigan, Arizona (three waves), Louisiana, Maryland, Mississippi, Delaware, Connecticut, Minnesota, Iowa. West Virginia AG subpoenas.

Bans in force

Montana, Nevada (disgorgement), Connecticut (signed 24 Jun 2025), New Jersey, New York, California (AB 831, from 1 Jan 2026), Indiana (1 Jul 2026), Maine (Jul 2026, exact date disputed), Tennessee, Louisiana (Act 182 from 1 Aug 2026, plus Act 48 making gambling crimes a racketeering predicate), Iowa (regulator powers). Oklahoma SB 1589 takes effect 1 Nov 2026 as a felony after the veto was overridden. Failed or pending: MD, MS, FL, VA, MN, MA, OH, IL, TX, AR, HI, DC, Wyoming drafts; NJ S1500 would license sweeps instead.

Why brands left

132 exit rows. Most are state exits timed to a ban taking effect or a regulator letter: when a bill passes or a C&D arrives, brands leave within weeks. Confirmed operator quotes mostly cite 'regulatory developments' without naming the order. Full shutdowns (about 24) are mostly small brands after the 2025 NY and CA waves and the 2026 bans, often with redemption deadlines and some unpaid-redemption complaints (SweepSlots). Big moves: Pragmatic Play left the US sweeps market after being named in the LA suit; VGW closed LuckyLand Slots (14 Sep 2026) after leaving 12+ states; PLAYSTUDIOS shut The Win Zone (board decision, $3M to $3.5M impairment in an 8-K); ProphetX moved to a CFTC-licensed exchange. Only 70 of 132 exits are confirmed; the rest are inferred from timing.

Player disputes and small claims

Redemption refusals, KYC voids, 'malfunction' voids and account closures show up in BBB complaints, forums and individual arbitrations, not in published judgments. We found no reported small-claims court judgment against a sweeps operator. Examples: WOW Vegas released $450k after a complaint, Crown Coins has a BBB F rating, and Chumba voided a jackpot as a malfunction.

Not verified or conflicting

A reported Chumba class certification (19 Aug 2026) could not be confirmed and is left out. Conflicts flagged in the rows: VGW's Delaware exit date, Stake's Illinois exit start, Maine's ban effective date (14 vs 29 Jul), whether Arizona sent Stake a C&D, and whether Sixty6 closed. No documented exits by payment or KYC vendors.

Questions for counsel (Silvergames)

Can we prove each player accepted the current ToS (logged, versioned clickwrap) and give notice before changing terms (Miranda, Wolters, Urdan)? Does the arbitration clause survive an unconscionability challenge (Portugal)? Is the geo-block list current for Oklahoma (1 Nov 2026), Louisiana, Indiana, Maine, Tennessee, Iowa and the C&D states? Do affiliate, streamer, studio and payment contracts carry indemnities, given these parties are now named in suits? Do the Sweeps Rules state clearly when a win is void? If we leave a state, can players still redeem SC? Are we collecting sales tax where Louisiana-style claims could apply?

  • 2026-09-28: court allowed ARB to file the award and gave Joyce 30 days for a 5-page response; ARB's motion to compel and Affirm/Apple motions to dismiss still pending
Money
Damages sought $12.5M total; award: nothing to plaintiff
Takeaway for counsel
Once a player starts arbitration, JAMS rules can stop them from walking away; arbitration choice-of-law clauses can strip state consumer claims.

298 case and matter rows (lawsuits, arbitrations, regulator orders, government suits, bans), 132 brand-exit rows, 31 loss-recovery statutes and 36 social-casino precedents. Built from court dockets (CourtListener, PACER filings), AG and regulator releases, statute text, operator notices and legal press. Each row has a confidence tag: docket/primary, press or secondary.

Currency. Research current to 8 October 2026; site last updated 16 October 2026. Court dockets, bills and operator notices change weekly; anything after the research date is not yet reflected. Scheduled dates after the cutoff (effective dates, hearings, deadlines) are shown as "next" on the relevant card.

Method. Built from court dockets (CourtListener, PACER filings), attorney-general and regulator releases, statute text, operator notices and legal press, reviewed to 8 October 2026. Every row carries a confidence tag: docket or primary, press, or secondary. The 10 October 2026 litigation review (136 entries) is superseded by this file; its counting rules carry over: arbitration stages are not extra lawsuits, and unverified reports stay labelled.

Status rules. "Pending" reflects the last identified public event, not a live clerk certification. "In force" for a law means signed and effective (or effective on the stated date). Brand exits marked "likely" or "secondary" are inferred from timing or forum reports, not operator statements. Neither a missing state entry nor an operator's withdrawal establishes legality or closure.

Reading the tags. Red: ban in force. Orange: regulator or government action. Yellow: private litigation. Green: money paid or awarded. Takeaways are pointers for counsel, not legal advice. Allegations are not findings of wrongdoing; counsel should review operative pleadings, signed orders and current statutes before advising.
